Most were surprised when Texas A&M senior Ainias Smith was arrested on a trio of charges last month. That's not who they thought Smith was, and it turned out they were right, because the charges were later dropped. Smith missed a chance to represent himself and A&M at the Southeastern Conference Media Days last month, but he was front and center in the Kyle Field media center a few hours before A&M's first practice of fall camp late Wednesday afternoon. "That was a tough little time," Smith said. "I guess you could say my main thing about that whole situation was just lay low, keep praying and keep faith and let God take over basically." Smith was arrested on charges of DWI, possession of less than 2 ounces of marijuana and unlawfully carrying a weapon.

The only thing he turned out to be guilty of was poor judgement, because the person in the car confessed to owning the marijuana and gun. Some had to think Smith was guilty, and possibly some still have doubt of his total innocence. "I think he came out and explained it," A&M head coach Jimbo Fisher said. "You tell the truth and you move on and don't worry about it. You can't worry about that. You have to go play and do the right things and make the right decisions each and every day." Smith was disappointed he didn't get to attend the SEC Media Days in Atlanta. "It was a great opportunity to build my brand and get a little bit more exposure for myself," Smith said. "But now that that's past, [I'm] not able to worry about that any more, and I'm excited to play ball. I mean, it's all I got left now." - Bryan/College Station Eagle

While dealing with the aftermath of a July arrest for DUI, possession of less than two ounces of marijuana and gun possession, Texas A&M wide receiver was unable to attend SEC Media Days. He was exonerated and charges were dropped, so this week he was more than happy to meet the press. "That was a tough little time," Smith said. "I guess you could say my main thing about that whole situation was just lay low, keep praying and keep faith and let God take over basically." "He's a leader," A&M junior defensive back Antonio Johnson said. "He leads best by example." The three-star recruit from Sugar Land Dulles came to A&M as a wide receiver. He moved to running back when needed then moved back to receiver. He also returns punts. He's Fisher's Swiss Army knife. "He'll be whoever he needs to be," said Johnson. "That's the best way I can put it." - Bryan/College Station Eagle

Texas A&M senior linebacker Chris Russell has been charged with failing to identify and giving false/ficticious information during the arrest of teammate Ainias Smith who had all his charges dropped from the July 20 incident. Smith had a trio of charges dropped Friday, which was the same day Russell turned himself in at the Brazos County Jail, reported the Houston Chronicle's Brent Zwerneman. Russell was released Saturday morning.

Russell was with Smith when the senior wide receiver and punt returner was arrested on charges of DWI, possession of less than 2 ounces of marijuana and unlawfully carrying a weapon. Russell provided a fake name and date of birth when asked for both by police, Zwerneman reported. Smith denied owning the handgun or marijuana as did the passenger, which at the time wasn't identified. Russell later returned on July 20th to provide a statement that he owned the marijuana, but prosecutors didn't move forward with charges because they were unconvinced of Russell's statement. However, the University Police moved forward on the fact Russell provided false information. Gun possession is legal in Texas if no other crime is being committed and Russell wasn't arrested at that time for supplying false information, a decision made by the officers on the scene, reported the Chronicle. - Bryan/College Station Eagle

Berman spoke to College Station lawyer Craig Greening, who is representing Smith. "I confirmed with Ainias himself that the suspension has been lifted," Greening said.   The lawyer for A&M football player Ainias Smith said Friday his client is innocent of charges that got him arrested early Wednesday. Smith was charged with driving while intoxicated, possession of less than 2 oz. of marijuana and unlawful carrying of a weapon, according to police records. They all carry misdemeanor charges. "I've reviewed the police reports in the case," College Station attorney Craig Greening told Houston Fox26's Mark Berman on Friday. "I'm board certified in criminal law and I'm designated as a lawyer/scientist certified by the American Chemical Society; I've done DWIs for years. I've prosecuted them and I've defended them. I've reviewed the reports in this case and it was obvious that Mr. Smith was not intoxicated." A new law passed in 2021 allows for possession of a firearm in your car for those under 21 years of age as long as you're not committing another crime that's greater than a Class C misdemeanor or a traffic ticket, Greening said.

"Now that we have the passenger's statements stating that the marijuana was his and that Mr. Smith didn't know about it, never possessed it and also never smoked marijuana that day, there was no crime committed by Mr. Smith from what I've reviewed and all the reports that I've been able to see up to this point." Smith was pulled over by University Police while driving 51 mph in a 35-mph zone on University Drive. He was drifting in his lane, according to the probable cause statement. After failing multiple physical intoxication tests, Smith was arrested and consented to a breathalyzer test, which came back with .066 and .061 blood alcohol content readings. The legal limit in the state of Texas is .08. - Bryan/College Station Eagle

Texas A&M was picked to finish second only behind Alabama in the Southeastern Conference's West Division, according to the media poll by those attending this week's SEC Football Media Days. The Aggies had a trio of first-place votes and 968 points from the 181 voters who attended the four-day event at the College Football Hall of Fame. Alabama and Georgia dominated the SEC's first-team offense and defense with eight and five selections, respectively. Arkansas, Auburn and LSU each had two players selected. A&M was among four teams that didn't have a first-team pick on offense or defense, but junior Nik Constantinou was the first-team punter. A&M junior running back Devon Achane, junior defensive back Antonio Johnson and junior offensive lineman Layden Robinson were second-team picks. A&M junior defensive lineman McKinnley Jackson and senior wide receiver Ainias Smith were third-team picks. Smith was a second-team pick as a return specialist, while Achane was a second-team pick as an all-purpose player. Smith also earned third-team honors as an all-purpose player. - Bryan/College Station Eagle
